intu Credit Card Rewards Programme Rules

 
  • 1. Introduction

    These terms and conditions (the ‘Rules’) apply to the intu Credit Card Rewards (the ‘Programme’), together with other incentives and rewards available to the intu Credit Card holder (‘Cardholder(s)’, ‘you’ or ‘your’) of the intu Credit Card.

    1.1 These Rules are an agreement between you and Us and are separate from your agreement with MBNA for your intu Credit Card. Unless otherwise indicated, defined terms in these Rules have the same meaning as in the terms and conditions of your intu Credit Card agreement. You can also find the Rules by logging on to intu.co.uk/creditcard/programme-rules

    1.2 In these Rules, we give particular meanings to certain words:

    "Account Opening Date" means the date your intu Credit Card Account was opened.

    "Card" means a valid intu Credit Card issued by MBNA.

    "Eligible Card Purchases" means any card purchase you make with your card, but excludes:

    • cash substitute transactions such as non-sterling currency, casino and gambling-type transactions;
    • balance transfers, money transfers and cash advances;
    • finance charges;
    • default charges;
    • interest;
    • payment protection insurance premiums;
    • fees including non-sterling transaction fees and card fees; or
    • any other account activity, unless we specifically contact you with details of a special offer.

    "MBNA" means MBNA Limited.

    "Spending Thresholds" means (i) £250 of Eligible Card Purchases within the first 90 days of your Account Opening Date; (ii) £3,000 of Eligible Card Purchases within the first Year of your Account Opening Date; (iii) £5,000 of Eligible Card Purchases within the first Year of your Account Opening Date; (iv) £3,000 of Eligible Card Purchases in each Year following the first Year of your Account Opening Date; and (v) £5,000 of 'eligible card' purchases in each Year following the first Year of your Account Opening Date.

    "We", "Us" or "Our" means intu Shopping Centres plc.

    "Year" means 365 days.

    "Your Email Address" means the email address registered on your intu Credit Card Account.

2. Earning intu Gift Cards

You can earn up to three intu Gift Cards in your first Year and then up to two intu Gift Cards for each following Year by using your intu Credit Card to make Eligible Card Purchases. When you reach the relevant Spending Threshold, within 60 days you will receive a unique code via email to Your Email Address, which you can redeem for an intu Gift Card at any intu Customer Service desk within 12 months of such email. intu Gift Cards can be spent in any intu shopping centre in the UK, at participating retailers that accept Mastercard. intu Gift Cards are valid for a Year from the date of issue – it is your responsibility to check the expiry date on your intu Gift Card and make sure that you use it by that date. 3. Welcome intu Gift Card

You will receive a unique code via email to Your Email Address for your Welcome £20 intu Gift Card when you make £250 of Eligible Card Purchases within 90 days of your Account Opening Date, which you can redeem for an intu Gift Card at any intu Customer Service desk within 12 months of such email.

4. intu Gift Cards in your first Year

In the first Year from your Account Opening Date, you will earn a £20 intu Gift Card when your spending on Eligible Card Purchases reaches £3,000. You can then earn an additional £20 intu Gift Card when your spending hits £5,000 within the same Year.

5. intu Gift Cards in subsequent Years

After your first Year, which starts on the anniversary of your Account Opening Date, you will earn a £10 intu Gift Card when your spending on Eligible Card Purchases reaches £3,000 and an additional £10 intu Gift Card when you reach £5,000 on Eligible Card Purchases within the same Year.

6. Eligibility to earn towards your Spending Threshold

6.1 To participate in the Programme, and to earn towards the Spending Thresholds and receive intu Gift Cards, your intu Credit Card Account must be open and not be in breach of the intu Credit Card agreement terms and conditions. (For example, if you haven’t paid on time or have gone over your credit limit on your intu Credit Card Account, you won’t be able to accrue towards your Spending Threshold until you have made the payment or put the balance back within your limit.) Where MBNA believe that there has been a breach of the terms and conditions of your intu Credit Card agreement they may reduce your total spend amount accrued.

6.2 Spending towards your intu Gift Card starts from the date MBNA apply your first Eligible Card Purchase to your intu Credit Card Account.

Only Eligible Card Purchases made within a Year from your Account Opening Date will count towards the Spending Thresholds required to obtain intu Gift Cards.
For example:

Only spending on Eligible Card Purchases accrued within a Year (starting on your Account Opening Date) will count towards the Spending Thresholds required for you to claim intu Gift Cards. On the anniversary of the Account Opening Date the total spend amount accrued will be reset to zero – amounts which exceed the Spending Thresholds won’t be carried over. This means that for example:
In any Year in which you spend over £3,000 you will receive an intu Gift Card. If you continue to make more Eligible Card Purchases in that Year, but don’t achieve the next Spending Threshold (of £5,000) that additional spending will be forfeited on the anniversary of your Account Opening Date and won’t be carried over into the next Year.

Similarly, if you qualify for two Gift Cards in any Year by spending £5,000, any further spending will not carry over to the next Year and will be forfeited on the anniversary date of Account Opening Date. Spending accrual towards the Spending Thresholds is only earned on Eligible Card Purchases as described in these Rules.

6.3 MBNA may withhold or withdraw spend accrued or earned on Eligible Card Purchases made whilst your intu Credit Card account balance is in credit.

6.4 Unauthorised or fraudulent transactions (including, but not limited to, those made with a lost, stolen or cancelled intu Credit Card) do not count towards your Spending Threshold.

6.5 Any refund or adjustment to an Eligible Card Purchase will result in the corresponding spend amount being deducted from the total spend amount accrued.

  • 7. Monthly Offers

    7.1 As a Cardholder, you are eligible for exclusive retail and leisure offers negotiated and managed by us. These offers will be sent to Your Email Address on a monthly basis, they are also on the intu website at intu.co.uk/creditcard

    7.2 Each offer has its own specific expiry date, terms, restrictions and conditions which are set by the merchant ('Offer Specific Terms') and published together with the offer details via the email or on the intu website. Please ensure that you review the Offer Specific Terms and the merchant’s terms and conditions and returns policy before purchasing the offer.

    7.3 To be eligible to receive the monthly offer email, your intu Credit Card account must be open, not in breach of your intu Credit Card agreement terms and conditions and you must opt in to receive marketing emails from both MBNA and Us. We will send all emails to Your Email Address.

    7.4 All offers are only valid when purchased with your intu Credit Card.

  • 8. Gourmet Society

    8.1 As a new customer you will be eligible to receive a free 12-month digital membership of The Gourmet Society, which will allow you to benefit from savings at a variety of participating restaurants.

    8.2 Once your intu Credit Card Account is open you will receive an email within 30 days to Your Email Address. The email will contain a unique code that can be redeemed via a link in the email for a free 12-month digital membership of The Gourmet Society. In order to activate the code and redeem your digital membership you will need to provide The Gourmet Society with your name and address details.

  • 9. Making changes and how we’ll let you know

    9.1 We may change these Rules at any time. You can read the current Rules by going to the intu website: intu.co.uk/creditcard/programme-rules. When any change is made, intu will post the updated version of these Rules on the intu website and we may send them to you in writing by post or email to your email address. Each updated version of the Rules will replace the prior version(s) entirely, unless otherwise stated. It is your responsibility to review the Rules to be aware of any changes.

    9.2 We may:

    • change, limit or end the Programme, or any part of it; or
    • discontinue, or replace any reward with a reward of similar specification;
    • modify, limit or remove any or all of the participating benefits, features or special offers, at any time.

    We may do any of the things referred to in paragraphs 9.1 and/or 9.2 for one of the following reasons:

    • changes to the cost of providing this service;
    • changes to law, regulation, good practice or other similar factors that affect us, or we think may affect us;
    • changes we need to make to ensure we continue to operate our business in a way that means we are an effective and efficiently-run business which is profitable, taking into account the competitive market and economic climate.

    9.3 Changes may affect outstanding transactions and Spending Thresholds and may include, but are not limited to, the spending amount required to receive intu Gift Cards or any other reward; the type of transactions qualifying towards Spending Thresholds; and the type of rewards, or otherwise, if applicable.

    9.4 We reserve the right to withdraw the entire Programme or remove the Programme from selected customers. We will give you 30 days’ written notice if the Programme is being removed from your intu Credit Card Account. We may do this for any of the reasons set out above.

10. What happens to your rewards if your card account is closed?

If your intu Credit Card Account is closed, all current benefits and rewards are immediately forfeited. If you have qualified for your Spend Threshold prior to account closure your intu Gift Card would still be issued.

11. General

11.1 We reserve the right to:

    • disqualify anyone from participating in the Programme; or
    • refuse to award or permit earning and/or redemption of intu Gift Cards or other Programme rewards

if, in MBNA’s judgment, the Cardholder, or any other person(s) acting with their permission using the intu Credit Card, have violated any of the Rules (including, but not limited to, acts of fraud or other abuse).

11.2 Rewards the Cardholder have earned cannot be combined with rewards earned on any other credit card account issued by MBNA (whether or not the other account is held by the same customer). Rewards earned or redeemed cannot be used as a contribution to, or a substitute for, a monthly card minimum payment towards the intu Credit Card.

11.3 Any decision made by us regarding all aspects of the Programme (including Spending Threshold, redemption and any discrepancies) shall be final.

11.4 You are responsible for any tax liabilities arising from your participation in the Programme.

11.5 Nothing in the Rules shall operate to exclude or limit liability for:

    • personal injury or death caused by our negligence or our sub-contractors;
    • fraudulent misrepresentation; or
    • any other liability which may not be excluded under law.

11.6 We will not be liable to you for any losses or costs caused by our compliance with any new regulatory or legislative requirement or for anything we have been unable to do because of things outside our control such as:

    • any machine, computer, payment or communications system failing to work;
    • industrial disputes; or
    • any supplier, person, business, machine or device refusing to initiate, record or accept a card purchase transaction.

11.7 Headings are for reference only and shall not alter or affect the meaning of these Rules, or any part of them.

11.8 We may, at any time, transfer to any person any or all of our rights and our duties in respect of the Programme or any part of it. If arrangements regarding the Programme do not change as a result of any such transfer, then we may do this without notice, but we will tell you if or when the arrangements do change. We may also arrange for any other person to carry out our rights or duties in respect of the Programme. Your legal rights and rights under these Rules will not be affected. You cannot transfer any of your rights or duties in respect of the Programme.

11.9 We can delay enforcing or choose not to enforce any or all of our rights under these Rules, in whole or in part, without losing them. We may apply our rights again at any time. If we have indicated to you that we are not, for the time being, enforcing our rights, we will let you know if we decide to do so.

11.10 If we cannot enforce a Rule it will not affect any of the other Rules; if we cannot enforce any part of a Rule it will not affect the other parts of that Rule.

11.11 These Rules are governed by English law, which will also govern the resolution of any disputes, although disputes may be heard by courts within that part of the United Kingdom you reside in. We will only communicate with you in English.
